Adam Kirby on Thursday faces an inquiry before the disciplinary panel of the British Horseracing Authority who will consider whether he committed a breach of the Rules of Racing at Kempton last month.
Kirby was unplaced aboard the John Butler-trained Pipers Piping and although the on-course stewards did not hold an inquiry on the day, the ride was subsequently reviewed by the BHA.
The panel will consider whether Kirby did not take all reasonable and permissible measure to ensure that the gelding was run on its merits.
Should Kirby, currently in fine form on the all-weather circuit, be found in breach, any penalty would have an entry point for suspension of 10 days, with a range of seven to 21 days.
The inquiry is scheduled to begin at 10.30am.
